Mediapro remains in bankruptcy proceedings pending the resolution of the appeals filed by PRISA TV

PRISA TV (formerly Sogecable), in light of Mediapro's announcement of an agreement with its creditors on a repayment schedule, wishes to make clear that the Spanish Bankruptcy Act prevents such agreements until all incidents brought before the judge have been resolved.

AVS (Audiovisual Sport), a subsidiary of PRISA TV, has raised a number of issues before the court hearing the case:

  • Firstly, because the banks behind the 240 million euro syndicated loan to the parent company IMAGINA cannot be considered creditors. AVS believes that this cannot be considered a payable debt, because if it were, the scope of the suspension of payments would most likely affect the parent company.
  • In addition, AVS has asked that more than 219 million euros be considered ordinary credit, the sum corresponding to damages caused by Mediapro to AVS from the 19th day of the football season 2007/2008 till the end of the 2008/2009 season as well as damages caused by Mediapro's failure to hand over football broadcast rights to AVS, as ordered by the judge.

Only when the courts finally ascertain and rule on Mediapro's liabilities, will it be possible determine how to continue with bankruptcy proceedings.
